Yesterday, Judge Lucy Koh, vigorously condemned the decision of the lawyers for Samsung to influence the jury by the publication of evidence that had been excluded. Samsung was hoping to influence the court to release a set of slides and a press release that hoped to use at trial to prove that Apple was inspired by design from Sony to create the first iPhone, as its chief product suggests a pre-interview.
The judge demanded that the legal team of Samsung revealed exactly who wrote the press release and who authorized it. Koreans today presented a written response to the request of Judge Koh and explaining the reasoning that led Samsung to make this unusual movement.
According to The Wall Street Journal, Samsung released this evidence "in response to requests from the media" and denied the accusations:
"Far from violating any order, the transmission of Samsung to the public of public information contained in the documents before trial, is entirely consistent with the statements of this court, which said that" the operation of the litigation must be open to public opinion "."
The published material includes slides showing different designs of Samsung phones and an excerpt from the deposition of Shin Nishibori, former Apple designer. Curiously, the link to these slides do not work.
We've only been three days of trial and Samsung has started on the wrong foot. Both Samsung and Apple have plenty of money to hire the best lawyers and their legal teams certainly have the best minds in the field of patents.
The company had issued these documents evidence that the strategy of Samsung largely support the claim that Apple copied the design from Sony.
Be seen whether Samsung is punished for making these documents public.
